    Child maintenance 

    What is child maintenance? When a couple chooses to part ways, an arrangement regarding the provision of financial support to raise a child/ren. The responsibility falls on both parents to be financially able to provide for the child. The agreement can be made in private, after mediation (which we can provide if requested), or via the Child Maintenance Service.

     

    Private agreement

    This route does not require any involvement by a third party and is flexible.

     

    Mediator facilitated agreement

    We would be delighted to arrange mediation for you, in his situation we would meet with both parties to secure an agreement that is fair for all. This agreement would not be legally binding but would be given considerable weight by the court.

     

    Child Maintenance Service 

    This is where the two parties cannot agree on terms and use the Child Maintenance Service as a catalyst. There is a small fee. However, where the applicant has experienced domestic violence, is aged under 18 or lives in Northern Ireland, they are not required to pay this charge. 

    The aims of any of the above are the same: 

    • To calculate a reasonable payment amount;
    • To take action where a parent has not paid the agreed-upon child maintenance; and
    • To aid the parties to avoid disagreements.

     

    How we can help

    Lestons can assign family mediation specialists to create a mutually agreeable settlement, they will typically meet both sides for impartial discussions to determine points of common ground, then examine specific points as required, after this they will report their finding to our legal team who will create suitable reports for the court.
