    Driving under the influence of drink or drugs

    It is illegal to drive if either the amount of alcohol in your body (over the prescribed alcohol limit) or are under the effects of drugs (legal or illegal). Failure to provide a specimen during a roadside breath test or at a police station if you are suspected of driving under the influence of drink or drugs is an offence, which is treated as seriously as driving whilst under the influence of alcohol.

     

    The minimum punishment upon conviction for driving under the influence of alcohol is a 12-month ban. Although the Court does have discretion, the disqualification can vary depending on how far over the limit the driver was. The Court’s may offer you the opportunity to attend a drink driving rehabilitation course which once completed, can reduce the period of a ban by 25%. Loss of a job through losing your licence may be a defence factor, however, this would depend on your circumstances.
