Application for Discharge of Bankruptcy

Provided that you have met the terms of the bankruptcy order you can apply to be discharged, Here a Certificate of Discharge is issued by the Bankruptcy Court which will state the date from which you have been discharged from bankruptcy. Unless special circumstances are present you will normally have to wait for a year from the date of the bankruptcy order.
Where do I make my application?
If you were made bankrupt at the Royal Courts of Justice in the High Court then you should make your application to the High Court at the Rolls Building. If you were made bankrupt at the Royal Courts of Justice in the County Court then you should make your application to the Central London County Court sitting at the Thomas More Building. It is possible that your papers have been transferred to your local County court in which case the application should be made there.

To apply you will need to fill in a form, this is shown in our sample letters on the right, or available form, once completed you should return it to the court that made your original Bankruptcy Order, you will need to include a cheque or postal order for £70 made payable to ‘HMCTS’.

What happens next?
The court staff will go through the form to check everything is correct, if not they will contact you. If all is fine the form is passed to the Official Receiver’s Department for the staff there to process your application. As a general rule you should get the Certificate of Discharge within three to four weeks of the court Office receiving the application.
